‘We came in as victims and left as double victims’ The foundation (Stichting Rechtsbescherming) provides information about our (Human) Rights protection. The Legal Protection Foundation is a grassroots organization founded by victims of (mental) violence, abuse in youth care, and the legal order of the Kingdom of the Netherlands. They met eachother at the victim meeting of the De Winter Committee on 21 February 2020 in Nieuwegein where emotions ran high when we learned that our kidnapped children would not return home. 3 The legal protection foundation aims to protect the interests, to help protect the rights of citizens and to supervise the safeguarding of rights in Dutch law, policy and practice - which are involved in institutions and authorities, in particular the law due process of law and the right to family life - as laid down in Articles 2, 6, 8 and 10 of the Convention on Human Rights and/or the European Convention on Human Rights. 4

Together we can make EU law simpler, less costly and future proof. Our objective is to feed the assessment of the Commission with factual information on developments on the ground in the Member States. As an organisation working on rule of law related issues, in particular linked to justice systems, corruption, media pluralism and checks and balances, these efforts are part of the Regulatory fitness and performance. As an integral part of better regulation, the REFIT programme is based on citizens’ and stakeholders’ input.5

In reflection of the meetings of the CRC - Convention on the Rights of the Child, 89 Session (17 Jan 2022 - 11 Feb 2022), regarding Croatia, Cuba, Cyprus, Djibouti, Greece, Kiribati, Madagascar, The Netherlands and Somalia, we sent you our perspective to send you additional information regarding the situation in the Kingdom of The Netherlands. See our letter to the UN. 6

Reflecting to; ‘State of the World' Special Address by President von der Leyen at the World Economic Forum, 20 January 2022 via videoconference. “Europe's approach is completely different. We believe that trust and confidence are more sustainable than control and coercion. It is the attractiveness of our liberal democracies that the autocrats fear – our economic success, our civil liberties, and the freedom of speech and ideas. We must step up to defend these most valuable treasures of our democracies.” 7

6)

‘Our Europe of democracy is a promise that was born with the Liberation. Have you ever wondered why authoritarian regimes – all of them – are so afraid of Europe? We do not wage war, we do not impose our model. So why are they so worried about us? There is only one reason. Our values make them afraid. Because freedom leads to equality, justice, transparency, opportunities and peace. And if it happened in Europe, it can happen everywhere. Let us not forget who we are and what thirst for Europe there is in the world.' Speech 17 January 2022 by President von der Leyen on the occasion of the memorial ceremony for President David Maria Sassoli. 8 We will continue your mission, David! 9 “That work, if it proceeds, will now fall to Parliament’s current First Vice-President Roberta Metsola, a conservative from Malta who was already set to be elected as Sassoli’s successor next week.”10

7)

Human Rights Day 2021: Now more than ever, we must stand up for human rights. States should fully implement the European Convention and the Strasbourg Court’s judgments. 11 On 27 January Secretary General Marija Pejčinović Burić will participate in a special event to mark the International Day of Commemoration in memory of the victims of the Holocaust, with the participation of French Education, Youth and Sports Minister Jean-Michel Blanquer, and video speeches and video messages from survivors. The event will be followed by a debate on the Observatory on History Teaching in Europe.” 12

8)

The Kingdom of the Netherlands is an outsider in the world when it comes to constitutional review. The judge does not intervene in the assessment of the constitutionality of laws and treaties. 13 In countries such as Iraq, Cuba, North Korea and Saudi Arabia in particular, things are still done in the Dutch way, ie without testing. "That's not really a company you want to be in.” The Kingdom may decide for itself whether it believes that the legislature remains within the limits.

It is important that there is someone who independently assesses in concrete situations whether legislation meets certain requirements once that legislation has been enacted. 14 9)

The appointment of judges in the Netherlands is no more independent than in Poland or Hungary. On the basis of these European criteria, the Polish Council for the Judiciary has been suspended from the European Association of Councils for the Judiciary. But the Dutch Council, which campaigned for that suspension, is not making any noticeable effort to comply with that standard itself. 15

10) According to the government, the number of children placed out of their homes is probably

95,000 children, these are the so-called voluntary and forced (through the courts) evicted. 16 11) “This decision by the GI, the so-called perspective decision, is not a decision in a legal sense, but an

internal pedagogical decision. It has not been laid down by law and provides direction for answering the question of where a child will eventually grow up.” And: “The perspective decision as a pedagogical decision is closely related to the measure terminating custody.” 17 12) “Children who are placed out of their homes and their parents do not always receive the support

they need, Defense for Children concludes after research. The children's rights organization spoke with almost a hundred concerned care employees, who think that better care can prevent a large part of the out-of-home placements." “The research shows that in the first phase of their out-ofhome placement, children sometimes have little or no contact with their parents. Also, in many cases parents and children are not involved in decisions about this, so that they get the feeling that they have no say at all.” 18 “I didn't know what I had done wrong and yet I felt punished. Especially very alone. “When I got there I was still a child, so what I really needed was a home, with love and attention. A place where I could be and stay and where I could make mistakes and not be sent away. A safe place, where you occasionally get an arm around you or a hug.” 19 They were, as one junior minister who resigned in connection with the scandal put it, "steamrolled" by the system. Families were left in a state of ruin, by a state apparatus that became "the enemy of the people". Relationships disintegrated under the pressure, homes were lost, mothers have spoken tearfully of the financial and psychological anguish they suffered after being targeted by state officials.20 "Youth care is built on a culture of fear", "Revolution in youth care needed".

21 Help your company conduct a modern 'health check' on slavery. See the Modern Slavery Compliance. 22 13) The implementation of child protection measures is ‘twisted’ in execution policy, broken children

are the revenue model of youthcare chain partners. The security strategy to help children in vulnerable situations does the opposite. Organizations are 'twisted' when the natural principles of organizing have been lost, for example under an avalanche of unnatural management logic. 23

Stichting Rechtsbescherming 14) A perverse incentive existed for the authorities to seize as many children as possible regardless of

the veracity of accusations and lies, as they had to prove the efficiency of the algorithmic decisionmaking system. Parents and caregivers who were identified by the Dutch authorities as fraudsters, were for years given no answers to questions about when to get their children back.24 “Relocations after out-of-home placements” Submitter Don Ceder, Member of Parliament Christen Unie Copetitioner Lisa Westerveld, MP GroenLinks Addressed to; F.M. Weerwind, Minister for Legal Protection, M. van Ooijen, State Secretary for Health, Welfare and Sport.25 Answer to question 5, 6 Relocation after custodial placement. What are the average financial costs for placing a child out of home? What is the average cost of providing appropriate support to a parent and child at home for a year? See: Answers to Parliamentary questions about possible out-of-home placements for children as a result of the allowance affair. Question 8. Can you indicate the direct and indirect costs of an out-of-home placement per child? Answer question 8. “The direct costs of an out-ofhome placement differ greatly per situation. In the event of a forced custodial placement, costs will be incurred for the implementation of a supervision order or guardianship measure. The costs of this are around € 10,000 and € 6,500 respectively per year.

These are the costs for a child protection measure on an annual basis, which also includes a fee for the activities that are necessary in the event that an out-of-home placement is necessary. In addition, costs are incurred for the (residential) care of the children who have been placed out of home. These costs vary widely, depending on the type of aid used. When placed in a foster family, the costs are around € 16,000 per year. Placement in a living or treatment group costs approximately €100,000 to €150,000 per year. When placed in an institution for closed youth care, the annual costs are approximately € 170,000. In addition to this, ambulant youth care can be used. There is no insight into the indirect costs associated with an out-of-home placement.” 26 15) Is placing children out of home because of the various perverse financial incentives in the Dutch

youth care, human trafficking? 27 16) From foul investigations to false sentences. 28 “In the coming years, we - Jeugdzorg Nederland on

behalf of the Certified Institutions (GI), the Child Protection Board and the National Network Safe at Home on behalf of Safe Home - will jointly work on improving the fact-finding investigation in the youth protection chain. Our goal is to implement the actions that follow from the Action Plan to Improve Fact-Finding. This ambition is strong and will demand a lot from us in the coming years, especially from our institutions and especially from our professionals. They must be better equipped to conduct research, to draw up reports and petitions factually, carefully and to be traceable, and to be able to properly communicate with children and parents about this. To achieve this, practical and concrete support from our institutions and the professionals is needed over the next three years.” Date, 31 May 2018.

autonomous rights holders. The reservation to Article 26 CRC is an example of the way in which the 24 https://www.amnesty.org/en/latest/news/2021/10/xenophobic-machines-dutch-child-benefit-scandal/ 25 https://www.tweedekamer.nl/kamerstukken/kamervragen/detail?id=2022Z00700&did=2022D0153 26 https://www.sociaalweb.nl/wetten/antwoorden-kamervragen-over-mogelijke-uithuisplaatsingen-kinderen-door-toeslagenaffaire 27 https://www.binnenlandsbestuur.nl/sociaal/opinie/columns/het-einde-van-de-perverse-prikkels.4871619.lynkx 28 https://www.tweedekamer.nl/kamerstukken/kamervragen/detail?id=2021D35925&did=2021D3592 29 https://www.jeugdzorgnederland.nl/wp-content/uploads/2019/09/tk-bijlage-actieplan-verbetering-feitenonderzoek-in-de-

Dutch state views children. They are not seen as fully autonomous and are dependent on the choices of their parents. The child benefits scandal is once again holding up a mirror to us through this report and you see many points of departure for strengthening the rule of law. 30 18) LET JB maintains close contact with the Ministry of Justice and Security, the Public Prosecution

Service, the (national) police and intelligence services. The situation that occurs most often is a case in which it appears during implementation by the GI that regular deployment is no longer justified. The cost of a LET JB takeover amounts to 2.7 times the regular cost of the measure. An application to LET JB can only be made by a Certified Institution (GI). LET JB can only be reached for GIs and chain partners. - update 2021 31 19) A dedicated team within the Algemene Rekenkamer is investigating the role of central

government in youth protection. What are the research questions? “Do the ministers of JenV, VWS and BZK tackle and solve the structural problems in youth protection sufficiently effectively to ensure that young people in an unsafe situation receive the right help at the right time? Have the ministers done what may be expected on the basis of their legal duties, powers and responsibilities?” However, "The exchange of information between the Court of Audit and the audited organization is confidential and therefore not public. Not even invoking the Government Information (Public Access) Act (WOB request)." 32 20) EU parliament committee wants clarification on European Court of Auditors.”It is crucial for the

credibility of the European Court of Auditors that there is no doubt whatsoever about the integrity of the auditing EU institution. An independent investigation into allegations of misuse of EU funds and other abuses at the agency should clarify this.” 33 21) “What do US presidents Monroe and Truman, Soviet leader Brezhnev and Mark Rutte have in

common? An actual doctrine has been named after all four. While the world leaders from the recent past were all about a grand foreign strategy, the Rutte doctrine has recently become a term of abuse for everything that is wrong with Rutte's cabinet. Twitterers use #ruttedoctrine for a government that abuses its power, conceals failure and denies citizens justice.” 34 22) According to the court in Haarlem, Rutte's request to the municipalities was discriminatory and

contrary to the constitution. The court speaks of "racial discrimination, because this concerns a group of people of Somali descent, regardless of the nationality of those involved". In a letter, then State Secretary Rutte advised how municipalities could identify residents of Somali descent by searching the place of birth of their residents. If these people were also on welfare, the municipality was advised to check them extra. Mark Rutte believes that municipalities should be able to conduct targeted investigations into fraud among population groups. Rutte said this on Saturday in response to a ruling by the court in Haarlem. "Apparently that is not legally possible now. It is high time to change the law." 35 “Employees feel inhibited for fear of reprisals at work. They are afraid that they will be silenced or that they may forget about promotion. This part of the doctrine must also come to an end.” 36 23) Why The Hague is the city of peace and justice? In our city, justice is being done to ensure

international peace. But we recently wondered why this actually happens here: and of course we looked it up. “The Hague is increasingly known internationally for its peace and justice, with 30 https://www.venice.coe.int/webforms/documents/?opinion=1031&year=all 31 https://vng.nl/artikelen/factsheet-landelijk-expertise-team-jeugdbescherming 32 July 2021. https://www.rekenkamer.nl/actueel/lopend-onderzoek/rol-rijksoverheid-bij-de-jeugdbescherming 33 01 december 2021, https://www.accountant.nl/nieuws/2021/12/eu-parlementscommissie-wil-opheldering-over-europese-rekenkamer/ 34 https://www.trouw.nl/politiek/rutte-doctrine-is-een-scheldwoord-gewordenmaar-de-premier-blijft-er-vierkant-achter-staan~b8b4bd3d / 35 NU.nl, 19-05-2007 https://www.nu.nl/algemeen/1082182/rechtbank-rutte-zette-aan-tot-discriminatie.html 36 https://overheid.fnv-magazine.nl/012021/rutte-doctrine/

institutions such as the Peace Palace and the International Criminal Court.” The Hague is therefore filled with expats who work for these institutes, among others. 37 “On the edge of The HagueScheveningen, where the city merges into the dune landscape, one of the most important parts of The Hague, the legal capital of the world: the new buildings of the International Criminal Court.”38 24) “Khan also takes over at a time when the ICC is facing criticism for sluggish progress and the high

salaries of its judges. An independent expert review last year called for reforms after describing a "culture of fear" in the office of the prosecutor.”39 “In the Experts’ assessment, there is a general reluctance, if not extreme fear, among many staff to report any alleged act of misconduct or misbehaviour by a Judge (and in general, by a senior official). The perception is that they are all immune” (para 302).” 40 25) The Network: “The Presidents of the Supreme Judicial Courts of the Member States of the

European Union decided to form an Association whose Constituent Assembly was held on March 10, 2004 at the French Court de cassation with the financial support of the European Commission (AGIS program).” “The Network of the Presidents provides a forum through which European institutions are given an opportunity to request the opinions of Supreme Courts and to bring them closer by encouraging discussion and the exchange of ideas.”41 26) Echoing US President Harry Truman’s declaration but sounding more like Richard Nixon’s “I am not

a crook,” Prime Minister Rutte’s admission of accountability in announcing “the buck stops here,” seems like a rather arbitrary political moment to take responsibility. After all, it took some time for the Rutte Regime to get there. After the findings of the 17 December 2020 report titled “Unprecedented Injustice” (Ongekend onrecht) revealed in some depths of distasteful, knowledgeable Kingdom’s cover up, that if the Dutch government didn’t resign over this issue.42 27) “Broekers-Knol said she was 'very sorry' that she 'stepped over the democratic process' and passed

the municipal councils. Experts doubt whether there is a good legal basis for this. 'Can the government make this mandatory?' writes professor of General Law Jan Brouwer (University of Groningen) in a blog. He cannot find a good basis in, among other things, the Housing Act, the European Reception Directive or the Police Act. According to him, 'neglect of duties' by the municipalities is not an issue. "There seems to be only a alleged authority by the State Secretary." 43 28) “Today is World Children’s Day, and the 32nd anniversary of the adoption of the UN Convention on

the Rights of the Child. Despite the devastating impact of the COVID-19 pandemic on children worldwide, the overall well-being of children - especially girls - has improved dramatically in the last 32 years. But we risk backsliding if we do not tackle head-on the thorny issue of tax avoidance by wealthy individuals and corporations, enabled by weak corporate tax and financial transparency laws in states like Ireland, Switzerland and the Netherlands. Tax avoidance is, at its very core, a children’s rights issue. This is because children, more than any other group of rightsholders, depend on sufficient government tax revenue for the realization of their basic rights.” 44 29) Even worse, it's been decimated by tax avoidance and loopholes. A ProPublica expose revealed that

more than half of the 100 wealthiest billionaires in the US avoid the estate tax by using complex trusts. As we reckon with the human and financial costs of this pandemic, lawmakers should work 37 https://indebuurt.nl/denhaag/genieten-van/mysteries/waarom-is-den-haag-niet-de-hoofdstad-van-nederland~18080/

now to shore up the federal estate tax, shut down loopholes and trusts that serve no purpose other than tax avoidance, and consider implementing a billionaire income tax and annual wealth tax. These steps would help us capture the unequal rewards that have flowed to the top during the pandemic. They would reverse the decades of extreme inequality that left us so vulnerable to the pandemic in the first place. Finally, they would raise funds to bolster our public health infrastructure — and prepare us for whatever challenges lay ahead.45 30) New, indispensable forces have emerged. Brazil, Russia, India, China and South Africa - establishing

links with Latin America and the majority of countries in the Caribbean, Africa and India struggling for development – constitute the forces which in our era are willing to collaborate with the rest of the world’s countries, without excluding the United States, Europe or Japan. 46 31) This is not just a question of competitiveness. It is also more than a matter of technological

sovereignty. “ASML is one of the most important technology companies in the world. It is a major player in the global semiconductor value chain. And it is essential for chip manufacturers around the world. Technology and machines designed by ASML help to produce chips in Singapore, Korea or the US, to name a few. This company will play a major role in our efforts to make Europe more competitive and more sovereign in the technology sector. This is the aim of the "European Chips Act", which we will propose in the first part of next year. Our goal is for Europe to double its market share in chips by 2030, including for the most advanced chips.” 47 32) On our minds: Promoting, protecting and caring for our children’s health. But the pandemic may

represent the tip of a mental health iceberg – an iceberg we have ignored for far too long. It calls for commitment, communication and action as part of a comprehensive approach to promote good mental health for every child, protect vulnerable children and care for children facing the greatest challenges.48 A huge problem49 33) THE LOCKING UP OF 95.000 INNOCENT CHILDREN MUST STOP! https://www.hetvergetenkind.nl/stop
